"Anti-speculation measures should not fizzle out"
"투기 방지 대책이 실패해서는 안 된다"
The Moon Jae-in administration has come up with a set of measures to eradicate real estate speculation by civil servants. On Monday, it announced the package in a desperate bid to assuage public outcry over speculative land purchases by employees of the state-run Korea Land and Housing Corp. (LH).
문재인 정부는 공무원들의 부동산 투기 근절을 위한 일련의 대책을 내놓았다. 월요일 국영기업인 한국토지주택공사(LH) 직원들의 투기성 토지 매입에 대한 국민들의 항의를 진정시키려는 필사적인 노력으로 이 조치를 발표했다.
The measures are designed to prevent and detect any speculation by public workers using insider information. They are also aimed at meting out harsher punishment to speculators and confiscating their illegal gains. They are in line with the government's much-avowed zero tolerance toward any violators.
이 대책은 공무원이 내부 정보를 이용한 투기를 방지하고 탐지하기 위한 것이다. 이는 또한 투기자들에게 더 가혹한 처벌을 내리고 그들의 부당 이익을 몰수하는 것을 목표로 한다. 이 대책은 모든 위반자에 대해 정부가 계속 공언해 온 무관용 방침을 따른 것이다.
Under the anti-speculation steps, all civil servants will have to disclose all their assets, including property holdings, to prevent their speculative purchases. Heavier capital gains tax will also be imposed on real estate transactions to make it harder to profit from speculation. The government also plans to set up a regulatory body to oversee unfair and illicit property transactions.
이런 투기 방지 조치에 따라 투기성 부동산 구입을 못하도록 모든 공무원은 보유 부동산을 포함한 전 재산을 공개해야 한다. 투기로부터 이익을 얻는 것이 더 어려워지도록 부동산 거래에 대해 더 과중한 양도소득세가 부과된다. 정부는 또한 불공정하고 불법적인 부동산 거래를 감독하기 위해 규제 기관을 설치할 계획이다.
All the measures appear to be appropriate to fight against real estate speculation by civil servants who have easy access to confidential information on development projects. But it is still doubtful if the Moon government is determined to win the war on speculation. As such, it is unlikely to calm down the simmering public anger over the LH property speculation scandal.
이 모든 조치는 개발 계획에 대한 기밀 정보를 쉽게 얻을 수 있는 공무원에 의한 부동산 투기와 맞서 싸우는 데 적절한 것으로 보인다. 그러나 문재인 정부가 투기와의 전쟁에서 이길 각오가 되어있는지는 여전히 의문이다. 따라서 LH 부동산 투기 스캔들에 대한 대중의 끓어오르는 분노를 진정시킬 것 같지는 않다.
Rather, the government and the ruling Democratic Party of Korea (DPK) have given the impression that they are focused more on preventing voters from shifting their support to candidates of the main opposition People Power Party (PPP) in the upcoming April 7 mayoral by-elections in Seoul and Busan. It would be irritating if they are more interested in the elections than rectifying structural problems regarding the scandal.
오히려 정부와 여당인 더불어민주당(DPK)은 오는 4월 7일 서울과 부산에서 치러지는 시장 보궐선거에서 유권자들이 이탈하여 제1야당인 국민의힘(PPP) 후보자들을 지지하는 것을 막는 데 더 주력하고 있다는 인상을 준다. 부동산 투기 스캔들과 관련된 구조적 문제를 바로 잡는 것보다 선거에 더 관심이 있다면 비위에 거슬리게 될 것이다.
It is wrong for policymakers and politicians of the ruling bloc to try to portray the speculation scandal as the "accumulated evils" of the previous administrations. They should not forget that 20 LH employees purchased farmland in Gwangmyeong and Siheung, both in Gyeonggi Province, between 2018 and 2020 by using undisclosed information on an urban development project of building 70,000 apartments in the two satellite cities amid soaring housing prices. Land Minister Byeon Chang-heum served as the LH chief then.
여권의 정책입안자들과 정치인들이 투기 스캔들을 이전 정부의 "적폐"로 묘사하려는 것은 잘못된 일이다. LH 직원 20명이 2018년부터 2020년까지 경기도 광명과 시흥의 농지를 매입했는데, 이들은 주택 가격이 치솟는 가운데 이 두 위성 도시에 7만 가구 아파트를 짓는 도시 개발 사업에 대한 미공개 정보를 활용했다는 사실을 잊지 말아야 한다. 변창흠 국토부 장관은 그 당시 LH 사장을 역임했다.
The newest measures are also touching off a controversy over the government's plan on the forfeiture of any illegal gains from civil servants engaged in speculation. To confiscate such gains, the administration and the DPK plan to push for retroactive legislation which some critics argue is unconstitutional. If they want to give legitimacy to the legislation, they should strive to build a national consensus on the issue.
이번 조치는 정부가 투기에 관여한 공무원의 불법 이득을 몰수하겠다는 계획을 놓고 논란을 불러 일으키고 있다. 이러한 이익을 몰수하기 위해 정부와 민주당은 일부 비평가들이 위헌이라고 주장하는 소급입법을 추진할 계획이다. 입법에 정당성을 부여하려면 이 문제에 대한 국민적 합의를 도출하기 위해 노력해야 한다.
Most of all, the government and the ruling party should lay the legal groundwork for punishing civil servants more harshly for their speculative purchases of real estate and confiscating their illegitimate gains. Lawmakers of the rival parties should no longer drag their feet in enacting a law aimed at preventing conflicts of interest in public officials. Then they need to revise the anti-graft law, better known as the Kim Young-ran Act, to get tougher with corrupt and greedy officials. They should work together to prevent the anti-speculation measures from fizzling out.
무엇보다 정부와 여당은 부동산 투기 공무원을 더 가혹하게 처벌하고 그들의 불법 이익을 몰수할 수 있는 법적 기반을 마련해야 한다. 여야 국회의원들은 공무원의 이해 충돌 방지를 위한 법을 제정하는 데 더 이상 지체해서는 안 된다. 그런 다음 그들은 부패하고 탐욕스러운 관리들을 더 엄하게 다루기 위해 김영란법으로 더 잘 알려진 부정청탁금지법을 개정해야 한다. 그들은 투기 방지 조치가 실패하지 않도록 협력해야 한다.
