Samsung Electronics will sue Apple over its release of the iPhone 5 for infringing on its fourth-generation (4G) long-term evolution (LTE) connectivity patents, according to industry sources, Monday.
''It's true that Samsung Electronics has decided to take immediate legal action against the Cupertino-based Apple. Countries in Europe and even the United States ― Apple's home-turf ― are our primary targets,'' said an industry source.
The Korea's tech giant's move came immediately after industry sources confirmed Monday that the U.S. technology giant will unveil the iPhone 5 featuring 4G LTE in Korea. The sources said that Apple has agreed with local mobile carriers to release the LTE-enabled iPhone on the local market for domestic telecommunications frequencies.
The sources also added it's unlikely Apple would release the new iPhone using conventional third-generation (3G) networks.
''Apple claimed the existing 3G-related patents are standard essential patents (SEPs) according to our earlier commitment to the FRAND (fair, reasonable, and non-discriminatory) terms. But the story is totally different when you talk about LTE patents. These are new and highly-valued,'' said another source.
In a similar issue, Taiwan's HTC, which is also battling with the iPhone maker over patents, won a court battle over LTE, raising the possibility that Samsung's bet will fully pay off.
The Korean company was ordered by a U.S. jury to pay $1.05 billion in damages for an infringement of Apple's design patents. The jurors led by a controversial foreman Velvin Hogan simply ignored Samsung's insistence that Apple used its mobile patents without paying proper royalties.
The Seoul Central District Court ruled Samsung didn't copy Apple and ordered the latter to stop selling its iPads and iPhones, while the Tokyo Central District Court also favored the Korean technology giant by ruling it didn't infringe on the U.S. firm's patents.
The two companies are currently playing out similar fights in a court in Den Hague, the Netherlands and an appeals process in a German court this week.
''SK Telecom and KT will face some difficulty in their marketing strategies for the 4G LTE iPhone because of a fresh legal attack on Apple,'' said an industry executive, asking not to be identified.
Apple is being pressured due to Samsung's rapid rise in the LTE-enabled smartphone market. Samsung recently announced its Galaxy S3 smartphone achieved landmark sales that were a respective three and six times faster than the Galaxy S and Galaxy S2.
The company has sold 20 million Galaxy S3 smartphones, just 100 days after the handset was launched in May.

삼성전자가 애플의 전략 스마트폰인 가칭 `아이폰5’에 대해 4세대 이동통신인 LTE특허를 침해했다는 이유로 특허 침해 소송을 내기로 확정했다.10일, 삼성의 한 고위 관계자는 ``애플의 차세대 스마트폰에 대해 특허침해 소송을 내기로 결정했다’’고 밝혔다. 삼성 법무팀은 이미 `아이폰5’의 LTE 특허침해에 대한 법률적 검토를 끝마쳤다.
삼성전자는 제4세대 이동통신인 LTE와 관련한 통신기술 특허를 다량 보유하고 있다. 아이폰5가 LTE를 지원하는 만큼 삼성전자의 관련 특허를 피해가기는 힘들 것이라는 게 내부 판단이다.
삼성의 다른 관계자는 ``표준 특허 기술은 한계가 있다는 점이 미국 평결에서 확인됐다’’며 ``따라서 아이폰5는 상용 기술 특허로 적극 대응하겠다’’고 말했다.
한편 애플 차세대 아이폰은 차세대 이동통신기술인 롱텀에볼루션 (LTE)를 한국에서도 지원하기로 확정됐다.
SK텔레콤의 한 관계자는 ``주파수대역이 다르다는 걸림돌이 있지만 국내시장에서 LTE가 대세로 굳어지고 있는 것 만큼 애플도 SK텔레콤과 KT의 적극적인 구애를 마냥 나몰라라 할 수 없었다’’며 ``국내 소비자들도 LTE 기능이 지원되는 차세대 아이폰을 만나볼 수 있을 것’’이라고 말했다.
이에 대해 SK텔레콤 홍보실 관계자는 ``확인해 줄 수 없는 사안’’이라며 말을 아꼈고 KT홍보실 관계자 역시 ``고객사 관련한 부분은 얘기할 수 없다’’고 덧붙였다.
한편 애플은 12일(현지시간) 오전 10시 미국 샌프란시스코의 예바 부에나센터에서 열리는 내부행사에서 아이폰5를 공개할 예정이다. 출시 예정일은 이달 21일이다.
삼성과 애플과의 관계는 악화일로다. 애플이 아이폰5에서 메모리칩, LCD 등 삼성이 만드는 핵심 부품을 대부분 뺀 것으로 전해지면서 `삼성이 애플을 버리나’ 또는 `애플이 삼성을 버리나’ 논란이 가열되고 있지만 일단 소송전이 장기화되면서 애플의 공급선 다변화 정책은 더욱 탄력을 받을 것으로 예상된다.
앞서 애플은 지난달 31일(현지시간) 미국 캘리포니아북부연방법원에 삼성전자의 최신 스마트폰 갤럭시S3와 '갤럭시노트', 태블릿PC '갤럭시노트 10.1'을 특허소송 대상에 추가했다.
애플이 지난 2월에 삼성전자를 상대로 제기한 이용자환경(UI) 특허 침해 소송에 이 제품을 추가하는 형식으로 진행됐다.
